Violations Committed in the War in Ukraine: A Clear Case?

While Russia is the aggressor in the war in Ukraine, both sides have to comply during that war with international humanitarian law and both sides have human rights obligations. Both sides have committed violations but there are also instances of respect. The violations committed by the Russian Federation, however, are by far larger in scale and nature.

Professor Marco Sassòli will review the findings of the Organization for Security and Co-operation in Europe (OSCE) mission of enquiry into violations of international humanitarian law and human rights in Ukraine during the first five weeks following the Russian invasion of 24 February 2022. He will furthermore discuss to what extend such violations constitute international crimes and how States and individuals can be held accountable and what third States may and must do to stop such violations.

About Our Speaker

Professor Marco Sassòli has been appointed on 15 March 2022 as one of three experts on a mission to investigate violations of international humanitarian law (IHL) and international human rights law (IHRL) in Ukraine for the Organization for Security and Co-operation in Europe (OSCE). This mission was conducted under the Moscow Mechanism, at the request of Ukraine and following the suggestion of 45 participating States, including Canada.

Marco Sassòli, is professor of international law at the Faculty of Law of the University of Geneva, Switzerland. From 2001-2003, he has been professor of international law at the Université du Québec à Montreal, Canada, where he remains associate professor. He is commissioner and member of the Executive Committee of the International Commission of Jurists (ICJ).
