Biographie

Tony VanDuzer a rejoint la Section de common law en 1989. Il a été vice-doyen du programme d'anglais (1994-1995) et vice-doyen à la recherche de la Section (2006-2008). De 2018 à 2022, il a occupé la chaire Hyman Soloway en droit des affaires et du commerce. Avant de se joindre à la Section, il a pratiqué le droit des sociétés et le droit commercial à Toronto au sein du cabinet Fasken & Calvin (aujourd'hui Fasken). Il a pris sa retraite de la Section en 2024.

Le professeur VanDuzer a enseigné le droit des affaires national et international à la faculté de droit et au programme de MBA pour cadres de l'Université d'Ottawa, notamment le cours « Organisations des entreprises » et le cours de clinique de droit économique international TradeLab. Il a été professeur invité au Centre d’études internationales Bader de l’Université Queen’s en Angleterre, à l’Université de Westphalie-Wilhelms en Allemagne, à la Faculté de droit Te Piringa de l’Université de Waikato en Nouvelle-Zélande et à l’Université de Modène et de Reggio Emilia en Italie. Il a également été chercheur invité à l’Institut du commerce mondial de l’Université de Berne. Le professeur VanDuzer a animé plus de 20 formations courtes sur les questions de commerce et d’investissement, tant au Canada qu’à l’étranger, à l’intention de fonctionnaires de ministères canadiens et de représentants d’une douzaine d’États étrangers.

Les principaux domaines de recherche du professeur VanDuzer sont le droit des sociétés et le droit économique international. Parmi ses publications figurent « The Law of Partnerships and Corporations » (dont la cinquième édition est actuellement en vigueur et qui a été cité plus de 50 fois par les tribunaux, y compris la Cour suprême du Canada), ainsi que plus de 100 autres publications sur des questions de droit des affaires, du commerce et de l’investissement. En 2013, avec les professeurs Simons et Mayeda, il a co-écrit « Integrating Sustainable Development into International Investment Treaties: A Guide for Developing Country Negotiators », publié par le Secrétariat du Commonwealth. En 2020, il a codirigé avec Patrick Leblond, titulaire de la Chaire CN-Paul Tellier en affaires et politiques publiques, un ouvrage collectif intitulé « Promoting and Managing International Investment: Toward an Integrated Policy Approach ».

Tout au long de sa carrière, le professeur VanDuzer s’est souvent impliqué dans la réforme des lois et des politiques publiques. Avec le professeur Gilles Paquet de l’École de gestion, il a rédigé « Pratiques tarifaires anticoncurrentielles et Loi sur la concurrence : Théorie, droit et pratique », une étude majeure pour le Bureau de la concurrence, publiée en 1999. Plusieurs des recommandations de réforme de la Loi sur la concurrence ont été intégrées aux modifications adoptées en 2009. En 2005, son étude pour le ministère des Affaires étrangères et du Commerce international, « Health, Education and Social Services in Canada: The Impact of the WTO General Agreement on Trade in Services », a été déposée devant le Comité permanent des affaires étrangères et du commerce international. De 2002 à 2006, il a été membre du Conseil consultatif universitaire auprès du sous-ministre canadien du Commerce international et a participé à des projets d’assistance technique en droit des affaires et du commerce dans les pays en transition et en développement, notamment en Arménie, au Bangladesh, en Chine, au Salvador, en Géorgie, au Kirghizistan, au Pakistan, en Russie, en Thaïlande, en Ukraine et au Vietnam. Il a agi à titre d’évaluateur juridique externe pour l’Initiative de droit de l’Europe centrale et orientale de l’American Bar Association, fournissant des conseils sur un projet de loi sur le commerce extérieur pour la Bosnie-Herzégovine et un projet de loi sur la protection de la concurrence pour la Bulgarie. Il a également contribué à l’élaboration d’une nouvelle loi sur le commerce extérieur pour la Russie, adoptée par la Douma en 2005.

Le professeur VanDuzer a longtemps été coprésident du Groupe de droit international de la Faculté et professeur de recherche associé à l’École d’affaires internationales Norman Paterson de l’Université Carleton. Il a reçu plusieurs prix de la Section de common law, dont le prix d’excellence en enseignement (programme d’anglais) et le prix de l’engagement public (éducation et sensibilisation). Le professeur VanDuzer s’est beaucoup investi dans les concours de plaidoirie à la faculté de droit. Pendant de nombreuses années, il a entraîné l'équipe du concours de plaidoirie en investissement direct étranger (avec le professeur Daimsis et Jolene Hansell) et l'équipe du concours de plaidoirie en droit canadien des sociétés et des valeurs mobilières (avec le professeur Vasudev), et il continue d'apporter son aide en tant que juge d'entraînement.
